MontaguLaw Contest Rules



These are the official rules (the “Rules”) that govern how the MontaguLaw intellectual property skill contest (the “Contest”) will operate.  In the Rules, “we,” “our,” and “us” refer to MontaguLaw, P.C., the sponsor of the Contest. “You”, “yourself,” and “Your” refer to an eligible Contest entrant.  The promoter of the Contest is MontaguLaw, P.C., with an address of 1120 Avenue of the Americas, 4th Fl, New York, NY 10036.





1.1  Unless otherwise prohibited by law, this Contest is open to legal residents of the United States (excluding Puerto Rico) aged 18 or over. 


1.2  Employees, officers, directors, agents, and representatives of MontaguLaw, its affiliates, subsidiaries, or related companies (and their immediate family members and/or people with whom they are domiciled), and anyone directly or indirectly connected with this Contest, may not enter.


1.3  By participating in the Contest, you agree to these Rules and to the decisions of the Judges, whose decisions are final and binding in all respects


2.     HOW TO ENTER:

2.1  Entry to this Contest is free; no purchase is necessary. 


2.2  The Contest begins at 12:00 am EST on December 24 2010 and ends at 12:00 am on April 1, 2010 (the “Contest Entry Period”). Entries must be submitted during the Contest Entry Period by submitting an entry online at Entrants must follow the instructions on the website.


2.3  Entrants will be asked to submit answers to three questions that relate to a video available on the website. 


2.4  For purposes of this Contest, “receipt” of an entry occurs when our servers record the entry information resulting from the entrant clicking the “Submit Entry” button on the website.


2.5  To be eligible for judging, an entry must meet the following requirements:


·         It must be received during the Contest Entry Period.

·         It must be in English.

·         It must contain responses to all three questions.

·         It must otherwise comply with the terms contained herein.


2.6  We are not responsible for lost, late, corrupted, misdirected, incomplete, or ineligible entries. 


2.7  By submitting your entry, you grant MontaguLaw a perpetual, non-exclusive, royalty-free licence to use, copy, add to or alter the entry in its discretion, and to publish it (including in any altered form, and together with other Contest entries or other materials) throughout the world in all media now known or developed at a later date without compensation to you and without right of notice, review or approval of any such use of the entry.


All entries must be original.  You warrant to MontaguLaw that:

·         use of your entry and any other material which you provide to MontaguLaw will not infringe any rights of any person or organisation (including copyright, trademark, trade secret, rights of confidentiality, privacy and publicity);

·         your entry does not contain falsehoods or misrepresentations;

·         your entry is not abusive, obscene, defamatory, threatening, pornographic, harassing or racially or ethnically offensive;

·         your entry does not contain any advertisement or solicit any business;

·         your entry does not contain any material that is in poor taste or that is prohibited by applicable laws or regulations.


2.8  We reserve the right to remove any entry and/or bar access to the website if we become aware that an entry infringes any of the above rights and/or contains any material that is prohibited by the Rules.


2.9  We reserve the right to disqualify any entries that do not comply with these Rules. Entrants found tampering with or abusing any aspect of this Contest, as solely determined by us, will be disqualified. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be in violation of criminal and civil law, and, should such an attempt be made, then we reserve the right to seek damages from any such person to the fullest extent permitted by law.



3.1  Winners will be determined at the sole discretion of MontaguLaw, P.C.  Criteria for judging include:

·         Comprehensiveness;

·         Originality of thought; and

·         Overall style and content.



3.2  The decisions regarding determination of the winners are final and binding.


3.3  In the event that a winner, for any reason, does not receive his or her prize, please notify, in writing, MontaguLaw, P.C., 1120 Avenue of the Americas, 4th Fl, New York, NY 10036.


4.     PRIZES:


Grand Prize – Trip to Miami, Florida. The Grand Prize includes: round trip coach airfare for one from the any point in the continental US; Fontainebleau Sorrento Hotel stay for three nights included. Selection of trip details, including without limitation, travel dates, airport, airline, and hotel are solely within our discretion. All other expenses not stated herein as part of the Grand Prize are the winner’s sole responsibility.   – approximate value $1,400 


4.1  Only the prizes listed above will be awarded. Prizes are non-transferable and cannot be assigned, redeemed for cash, and no substitutions are allowed, except in the case of circumstances beyond our control we reserve the right to substitute prizes of an equal or greater value.  


4.2  Odds of winning will depend on the application of the judging criteria to the eligible entries received, relative to the performance of all entrants and the number of eligible entries received, and does not involve chance.


4.3  Unless otherwise indicated, all applicable taxes, insurance and registration fees connected to the receipt or use of the prize by the winners are the sole responsibility of the winners.


4.4  Restrictions: Some prizes (such as travel) may only be available on or between specified dates. Some prizes may be subject to participants' fulfilment of health and travel requirements. 


4.5  We expressly disclaim any responsibility or liability for injury or loss to any person or property relating to the delivery and/or subsequent use of prizes awarded.


4.6  We make no representation or warranties concerning the appearance, safety or performance of any prizes awarded.


4.7  We reserve the right to cancel or reschedule the Grand Prize trip, in whole or in part, in our sole discretion, as well as the right, in our sole discretion, to dismiss the winner from further participation in the Grand Prize trip as a result of conduct that is considered improper or offensive, is likely to be detrimental to the health or safety of the winner or other individuals, or demonstrates that the individual is not capable or unwilling to participate fully in the trip.




5.1  Prize winners will be notified 45 days after the Contest closing date, or as soon as possible after that, to the email and/or phone number which they have given with their entry, and must claim their prize within 14 days of being notified.


5.2  In the event that any winner cannot be contacted within 60 days after the Contest closing date, the promoter reserves the right to award the prize to a substitute winner who will be chosen at the same time as the original winners.


5.3  As a condition of winning the prizes, the winners must complete, sign and return confirmation of their eligibility, to the extent permitted by applicable law, an exclusion of liability and a publicity release and any other applicable forms required by a taxing authority within 30 days of receipt of prize notification or the prize will be forfeited. 


5.4  By accepting the prize, the winner consents to our use of their name, photograph and/or likeness, county, voice, and statements made by or attributed to them, in perpetuity, in any and all media now known or hereafter developed (including, without limitation, print, broadcast and internet), for all legitimate business purposes including advertising and promotional activities without any compensation, unless prohibited by law.


5.5  Should a winner make any false statement(s) in any document referenced above, the prize will be forfeited or, if the prize has already been awarded, the winner will be required to promptly return his/her prize to us.



6.     PRIVACY: We will be collecting personal data about entrants in accordance with our privacy policy. Any personal information collected in connection with the Contest will be used only for administration of the Contest and will not be otherwise used or disclosed without your prior consent. Please review the privacy policy at By participating in the Contest, you agree to our collection and usage of your personal information in accordance with the privacy policy and acknowledge that you have read and accepted our privacy policy.



7.1  To the extent permitted by applicable law, MontaguLaw, and its officers, directors, employees, agents and representatives (collectively “Released Parties”) exclude all liability whatsoever for any injuries, losses or damages of any kind arising from or in connection with, either directly or indirectly:

·         the awarding, acceptance, receipt, possession, use and/or misuse of any prize awarded herein; and/or

·         participation in the Contest or any prize related activities, including but not limited to travelling to or from any prize related activity.


7.2  Upon delivery of the prize to the winner, we will be deemed to have awarded the prize to the winner with winner assuming full responsibility for the prize.


7.3  To the extent permitted by applicable law, Released Parties are not responsible for:

·         technical, hardware, software, telephone or their communications malfunctions, errors or failures or any kind;

·         lost or unavailable network connections, website, internet, or ISP availability, unauthorised human intervention, traffic congestion, incomplete or inaccurate capture of entry information (regardless of cause);

·         failed, incomplete, garbled, jumbled or delayed computer transmissions which may limit one’s ability to enter the Contest, including any injury or damage to your or any other person’s computer relating to or resulting from participating in the Contest or downloading any materials in the Contest.


7.4  Our failure to enforce any term of these Rules shall not constitute a waiver of that provision.



8.1  These Rules are governed by and will be interpreted in accordance with the laws of the State of New York, excluding its choice of law rules, and any disputes arising out of or in connection with these Rules and/or the Contest will be subject to the exclusive jurisdiction of the Supreme Court of the State of New York, County of New York or the Federal District Court for the Southern District of New York. 


8.2  The various provisions of these Rules are severable and if any provision is held to be invalid or unenforceable by any court of competent jurisdiction then such invalidity or unenforceability shall not affect the remaining provisions.
